Allion has a team of specialist workplace relations lawyers to support the needs of our corporate clients. The team is led by Kathy Reid, one of Western Australia's most respected practitioners in the workplace relations area with expertise across employment law, industrial relations and occupational safety and health (OSH). The Workplace Relations and Safety Team is committed to providing strategic, commercial and cost effective advice to clients to achieve the best possible short and long term outcomes for their business.
Workplace Relations
Our team has extensive experience in:
- the drafting and negotiation of contracts and agreements;
- employment issues including contractual and award interpretation, common law and statutory entitlements and remuneration and benefits;
- drafting and interpretation of employer policies;
- strategic issues including managing the effect on staff of restructuring and transmission of business;
- unfair dismissal, equal opportunity and occupational safety and health proceedings;
- industrial issues such as union right of entry, industrial action and collective bargaining; and
- employee misconduct investigations including fraud and harassment.
Occupational Health and Safety
Allion's occupational safety and health lawyers have acted in multiple State and Federal jurisdictions on a range of incidents and have experience across the full spectrum of OSH matters. Their experience includes:
- advising clients and officers on their obligations under relevant safety legislation, and how to meet those obligations;
- assisting clients with their safety management systems and policies, including fatigue management, bullying, drug and alcohol and isolated workers policies;
- advising on how to incorporate OSH compliance into contracts for employees and contractors;
- providing incident response assistance, for minor and significant incidents, including establishing legal professional privilege and assisting with notifications, investigations and interfacing with the regulators;
- assisting clients to comply with improvement and prohibition notices;
- representing clients being prosecuted;
- compiling due diligence submissions for officers and managers;
- advising clients on managing injured workers, including return to work and related workers' compensation issues;
- advising on the disciplinary process where there has been a breach of OSH policy; and
- providing training and seminars to officers, managers and employees.
